02Definitions

Consumer means a person acting outside their business. Business customer means anyone buying for their business (for example with an IČO or VAT number). Consumer-protection rights in these terms apply to consumers only; nothing in these terms limits the mandatory rights consumers have under Czech law or the law of their EU country of residence.

03Age and eligibility

• Digital products and free downloads: 16 years or older. Under 16 only with the consent of a parent or guardian.
• 1-on-1 mentorship: 18 years or older. Aged 16–17 only with the written consent of a parent or guardian (by message or email) given before the session; ideally the parent or guardian makes the payment.
• We may refuse or cancel an order or booking if we have reasonable doubts about your age or the required consent. If we cancel, any payment for the cancelled order or session is refunded in full.

04Digital products

Digital products are sample packs, synth presets, DAW project files and bundles delivered as downloadable files. Each product page describes the contents and any software needed (for example Serum 2 or Ableton Live). Please check compatibility before buying — third-party software is not included.

Who you buy from. Checkout, payment and file delivery are provided by Payhip Limited (England and Wales, company no. 08386910). When you buy or download a product, you enter into a contract with Payhip Limited, which supplies the file to you as reseller under its End User Licence. The products are created and owned by Freaxment, who sets the prices, grants you the additional music-production licence below, and provides support, replacements and refunds directly. Payments go to Freaxment’s own Stripe account; Payhip deducts its fee and the tax it handles.

Prices and tax. For customers in the EU and the UK, Payhip is the reseller for VAT purposes: it charges VAT at the rate of your country and pays it to the tax authorities. For customers in the USA and Canada, Payhip handles sales tax as marketplace facilitator. The final price, including any tax, is shown at checkout before you pay. Freaxment itself is not a VAT payer. Your bank may charge currency-conversion fees.

Ordering. Buy and download buttons on freaxment.com take you to Payhip’s checkout page on payhip.com. Before paying you confirm that you agree to these Terms and to Payhip’s End User Licence. The contract is concluded when Payhip confirms your payment (or, for a free product, when your order is completed).

Delivery. The download link appears immediately after checkout and is sent to your email address. If you do not receive it, check your spam folder and then write to legal@freaxment.com.

Free products are covered by the same terms and licence, except that no payment is involved. Like every Store order, a free download adds your email address to the Freaxment mailing list; you can refuse at checkout or unsubscribe at any time, and your download and licence stay unaffected (see the Privacy Policy).

05Right of withdrawal — digital products

Consumers normally have 14 days to withdraw from an online purchase. For digital content this right ends once supply has begun with the consumer’s express consent and acknowledgement (§ 1837(l) of the Czech Civil Code). Payhip’s End User Licence and the checkout confirmation provide exactly that: by proceeding with your download you consent to immediate supply and lose your right of withdrawal.

If you have not downloaded the file yet and want to cancel, do not download it and write to legal@freaxment.com within 14 days of the purchase — we cancel the order and refund you in full. Once a file has been downloaded, the purchase can no longer be withdrawn and is not refundable, except for defects as described below and in the Refund Policy.

06Licence for digital products

Payhip’s End User Licence gives you a basic personal licence to use the files and forbids copying and redistributing them. All rights in the products remain with Evgenii Vasilenko (Freaxment). As the rights holder, Freaxment additionally grants everyone who buys or downloads a product a non-exclusive, non-transferable, worldwide and perpetual licence for music production:

• Samples and presets: you may use them, modified or unmodified, inside your own musical works — including commercial releases, streaming, live performance, DJ sets, video and sync — royalty-free and without credit (credit is always appreciated).
• Project files: for learning and your own productions. You may reuse techniques, sounds and processing you learn from them, but you may not release the original track, its stems or recognisable parts of it as your own work.

You may not: resell, share, give away, upload or redistribute the files — as they are or modified — including in other sample packs, preset banks, template stores or sample-sharing sites; register raw samples with Content ID or similar systems; or use the products to train AI or machine-learning models.

Where this additional licence allows a use that Payhip’s End User Licence does not cover — in particular commercial use inside your own music — this additional licence applies. The ban on redistributing the files applies under both.

07Defects

Digital products must match their description and work as described. If a file is corrupted, incomplete or different from what was described, write to legal@freaxment.com within two years of delivery. We will fix or replace it; if that is not possible within a reasonable time, you are entitled to a price reduction or a full refund. Problems caused by incompatible or outdated third-party software are not defects.

081-on-1 mentorship

What it is. A 90-minute online session on Zoom covering music production, sound design, mixing or DJing, tailored to your level. The price is shown on the Mentorship page (currently $97 USD). The session itself is always provided by Freaxment under these terms, however you pay. We do not guarantee specific results.

Two ways to book and pay:

• Directly: you contact us via WhatsApp or email, we agree a date and time, and you pay in advance by bank transfer — in USD, EUR or CZK at the amount we agree (account details are sent to you personally). The contract is concluded when we confirm the booking in writing; the session is confirmed once the payment arrives. As Freaxment is not a VAT payer, no VAT is charged.
• Through Payhip: you buy the session on Payhip’s checkout (linked from the Mentorship page) and pay by card through Stripe. Any tax Payhip applies is shown at checkout before you pay. The contract is concluded when Payhip confirms your payment. You then get access to your Payhip client area, where you schedule the session or we agree the date with you by email or WhatsApp.

Rescheduling and cancellation. You can move a session free of charge if you tell us at least 24 hours before its start; we then agree a new date. If you cancel less than 24 hours before, or do not show up within 15 minutes of the start, the session is forfeited and not refunded — subject to your statutory right of withdrawal below. If we have to cancel or move a session, you choose between a new date and a full refund. If a technical problem on our side interrupts a session, we make up the missing time.

Recording. You may record a session for your own personal study only. You may not publish, share or sell the recording or parts of it. We do not record sessions unless we agree otherwise.

Your material. Projects and tracks you share stay yours. We use them only during the session.

Conduct. We may end a session without refund in case of abusive or harassing behaviour.

09Right of withdrawal — mentorship

As a consumer you may withdraw from a mentorship booking within 14 days of our written booking confirmation or your Payhip purchase, without giving a reason, by writing to legal@freaxment.com (you can use the model form in the Refund Policy). We refund the payment within 14 days of receiving your withdrawal, using the same payment method.

If you ask us to hold the session within those 14 days, you thereby request that the service starts before the withdrawal period ends, and we ask you to confirm in writing that you understand you lose the right of withdrawal once the session has been delivered. Once the session has been fully delivered, the right of withdrawal ends (§ 1837(a) of the Czech Civil Code). If you withdraw after part of the service has been provided, you pay a proportionate amount.

10Payment and security

• Card payments (products, and mentorship booked through Payhip) run through Payhip’s checkout and are processed by Stripe, a PCI DSS Level 1 certified payment provider, into Freaxment’s own Stripe account. Your card details are entered into Stripe’s secure form and never reach freaxment.com or us. Available methods are shown at checkout (cards; depending on your device and region also wallets such as Apple Pay or Google Pay). Payhip emails you a receipt.
• Bank transfers (mentorship booked directly) — international (SWIFT/SEPA) or domestic Czech payment. The account is always held in the name of Evgenii Vasilenko at Wise or a Czech bank; details are sent to you personally after we agree a session. Fees charged by your bank for sending the payment are paid by the sender. A receipt is available on request.
• Currency: if you pay in a different currency, your bank converts the amount and may charge a fee.
• Stay safe: we will never ask for your card number, CVC, passwords or one-time codes by WhatsApp, email or social media. Before a bank transfer, check that the account holder is Evgenii Vasilenko. If a message claiming to be from Freaxment looks suspicious — a different account holder, an unusual link, pressure to pay quickly — do not pay and verify first at contact@freaxment.com.
• Website security: freaxment.com is served only over encrypted HTTPS, has no user accounts or passwords and stores no payment data. Please report any security problem to legal@freaxment.com.

11Liability

Nothing in these terms excludes liability that cannot be excluded by law, including for harm caused intentionally or through gross negligence. Otherwise we are not liable for indirect losses, lost profits, data loss or damage caused by third-party software, plugins or hardware — please back up your projects. For business customers our total liability is limited to the price paid for the product or session concerned.

12Intellectual property

Music, artwork, logos, texts and other content on freaxment.com belong to Evgenii Vasilenko (Freaxment) or their respective owners. You may not copy or reuse them without permission, except as allowed by the licence above or by law.

Names and logos of third-party software shown on the site (such as FL Studio, Ableton Live, Bitwig Studio, Serum, Phase Plant and Rekordbox) are trademarks of their respective owners and are used only to describe what the mentorship covers. Freaxment is not affiliated with or endorsed by them.

13Complaints and disputes

Please send any complaint to legal@freaxment.com; we reply within 30 days. If we cannot resolve a dispute with a consumer, the consumer may turn to the out-of-court dispute resolution body: Česká obchodní inspekce (Czech Trade Inspection Authority), ADR department, Gorazdova 1969/24, 120 00 Praha 2, adr@coi.gov.cz, coi.gov.cz.

These terms are governed by Czech law; Payhip’s End User Licence is governed by English law. If you are a consumer living in another EU country, you keep the protection of the mandatory laws of your country and may also bring proceedings there.
